These Terms of Service ("Terms") govern your access to and use of our website, services, and any related platforms operated by Kokopelli Climbing LLC ("Kokopelli," "we," "us," or "our"). By using our website or booking a climbing experience through us, you agree to be bound by these Terms.

1. Services Overview

Kokopelli Climbing connects climbers with experienced, certified guides for outdoor climbing experiences in the U.S. and select international destinations. We serve as a platform to facilitate these connections and coordinate bookings, but we do not directly employ all climbing guides.

2. Guide Independence

All guides are vetted and certified by industry-recognized organizations such as AMGA, PCGI, or equivalent. While Kokopelli Climbing may recommend or refer guides, many guides operate as independent contractors or third-party service providers.

Kokopelli Climbing is not liable for any conduct, negligence, or disputes arising from services provided by guides acting independently or outside the scope of Kokopelli-organized experiences.

If a guide offers services or makes arrangements outside of the Kokopelli platform (e.g., separate tours, private bookings), those services are not covered under our policies, and Kokopelli disclaims all responsibility.

3. User Responsibilities

By booking a climbing experience, you agree to:

• Accurately complete all required registration or inquiry forms.

• Disclose any medical, physical, or psychological conditions that could affect your participation.

• Follow all safety instructions and local regulations.

• Sign any necessary liability waivers prior to participation.

4. Risk Acknowledgment

Climbing is an inherently dangerous activity. By participating, you accept all risks involved, including but not limited to falls, weather, equipment failure, and natural hazards. You release Kokopelli Climbing and its affiliates from any liability for injury, loss, or damage, to the fullest extent permitted by law.

5. Payments and Refunds

All payments are handled via third-party processors (e.g., Stripe, Paypal). Refunds, if applicable, are subject to our cancellation policy and may vary depending on the guide, destination, and timing of cancellation.

Kokopelli reserves the right to cancel or reschedule an experience due to weather, safety concerns, or guide availability.

6. Intellectual Property

All content on our website — including logos, text, media, and code — is the property of Kokopelli Climbing and may not be reproduced without written consent.

7. Privacy

We respect your privacy. Personal data collected via our forms and booking process is used solely for communication, scheduling, and service coordination. We do not sell your information.

8. Changes to Terms

Kokopelli Climbing reserves the right to modify these Terms at any time. Updates will be posted on our website, and continued use of our services constitutes acceptance of those changes.
