Dyno Sky LLC – Terms of Service for Kokopelli Climbing

Welcome to Kokopelli Climbing, operated by Dyno Sky LLC (“Dyno Sky,” “Kokopelli Climbing,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our websites, forms, and services. By accessing our website, submitting a form, or booking a climbing experience, you agree to these Terms.


1. Legal Entity & Brand Names

Kokopelli Climbing and Kokopelli Adventures are trade names used by Dyno Sky LLC, a registered limited liability company. Until DBAs (“Doing Business As” registrations) are filed, all legal rights and obligations related to this platform fall under Dyno Sky LLC as the owner and operator.


2. Services Overview

Dyno Sky LLC, under the brand Kokopelli Climbing, provides a referral platform connecting climbers with independent guide companies. We facilitate introductions, provide trip information, and help coordinate logistics, but each trip is operated solely by the guide company you are matched with.


3. Guide Independence

All guide companies in our network are independent, third-party providers. Dyno Sky LLC/Kokopelli Climbing does not employ, control, or supervise these companies. By using our services:

  • You acknowledge that guide companies are responsible for their own operations including safety, scheduling, permits, and performance.

  • Dyno Sky LLC/Kokopelli Climbing is not liable for injuries, disputes, or issues arising from services provided by third-party guide companies.


If a guide offers services outside our platform, those arrangements are outside the scope of these Terms and we disclaim all responsibility.


4. User Responsibilities

By using our services, you agree to:

  • Provide accurate information on all forms and bookings.

  • Disclose any medical or physical conditions affecting participation.

  • Follow all instructions and regulations from the guide company.

  • Sign any liability waivers required by the guide company before participation.


5. Risk Acknowledgment

Climbing and adventure activities carry inherent risks. By submitting a form or booking a trip, you:

  • Accept all risks associated with participation.

  • Release Dyno Sky LLC/Kokopelli Climbing from liability for injuries, losses, or damages to the fullest extent permitted by law.


6. Payments & Cancellations

  • Payments are processed through third-party providers such as Stripe or PayPal.

  • Refunds and cancellation policies are set by each independent guide company.

  • Dyno Sky LLC/Kokopelli Climbing is not responsible for disputes related to refunds or cancellations.


7. Intellectual Property

All website content — including logos, text, and media — is owned by Dyno Sky LLC and may not be copied or reproduced without permission.


8. Privacy

We respect your privacy. Information collected via forms or bookings is used solely for trip coordination and communication. We do not sell personal information.


9. Changes to Terms

We may update these Terms at any time. Continued use of our website or services after updates constitutes acceptance of revised Terms.


10. Acceptance of Terms

By submitting a form, booking a trip, or using our website, you:

  • Acknowledge Dyno Sky LLC as the legal entity operating Kokopelli Climbing.

  • Agree that all trips are operated by independent guide companies who assume full responsibility for their services.

  • Confirm you have read and accepted these Terms.



Kokopelli Climbing Tours – Cancellation & Weather Policy

By submitting a deposit, you agree to the following terms and conditions:

1. Deposits & Payment

  • A 20% deposit is required to confirm your booking.

  • Deposits are non-refundable but never expire and can be used toward any future tour if you cancel within the timeframes below.

  • The remaining balance is due on the day of your tour before climbing begins.


2. Cancellation by Clients

  • More than 30 days before your tour: Deposit is fully credited for a future tour (no expiration).

  • 15–30 days before your tour: Deposit is fully credited for a future tour (no expiration).

  • Less than 15 days before your tour: Deposit is forfeited.

  • Cancellations or downgrades within 48 hours of start time: Full originally booked price will be charged to cover guide time, travel, and preparation costs.


3. Reschedules

  • Reschedules requested 15–30 days before will carry over your deposit to a new date (subject to availability).

  • Reschedules within 48 hours will be charged the original tour price, even if moving to a shorter or less expensive tour.


4. Weather Policy

  • We make the final call on whether a tour runs based on safety.

  • Tours proceed in light rain or minor weather unless conditions are deemed unsafe by the guide.

  • Severe weather includes thunderstorms, lightning, heavy rain exceeding 0.25”/hour, or winds above 25 mph (per National Weather Service).

  • If we cancel due to severe weather:

    • You may reschedule at no cost OR

    • Receive a full refund of your deposit.


5. No-Shows & Late Arrivals

  • Failure to arrive on time or at all will be treated as a last-minute cancellation with no refunds or credits.


6. Safety & Conduct

  • Tours may be stopped if clients engage in unsafe or reckless behavior.

  • No refunds or credits will be given if a tour ends early for these reasons.


7. Reschedule Credit Expiration

  • Credits from canceled tours must be used within 12 months of the original booking date unless otherwise agreed in writing.


8. Agreement

  • By paying your deposit, you agree to all terms above.


Simple Summary

  • >30 days out: Full refund.

  • 15–30 days: Deposit converts to credit (1-year expiration).

  • <15 days: Deposit forfeited.

  • Within 48 hours: Full price charged if canceled or downgraded.

  • Weather: We decide. Unsafe = reschedule or refund. Light rain = tour runs.

  • No-shows: No refunds.

  • Full payment due before tour.

  • Credits expire after 12 months.

  • By paying deposit, you agree to these terms.
